A stalwart of the All Progressives Congress (APC) in Bauchi State, Alhaji Al-Mustapha Zubairu on Tuesday filed a suit before the Bauchi State High Court against the suspended State Chairman of the party Alhaji Aliyu Babayo Misau and the National Chairman Dr Abdullahi Umar Ganduje for allegedly committing ‘contempt of the court’.
Lead counsel to the complainant Barrister S.G Idrees said that the same court presided over by Justice Lamido K. Umar had on 4th April, 2023 issued an order of ‘interim injunction’ restraining Misau from parading himself as the state APC chairman and Ganduje from recognising him as such.
He said his client had earlier filed a suit against the chairman of the party for the allegations of committing anti party activities in the last 2023 general elections where he allegedly displayed his ballot paper in his polling unit showing he voted for the party’s house of assembly candidate but did not thumb-print for the governorship candidate of the party, consequent upon which, he was suspended by his Ward leadership of Kukadi/Gundari Ward.
This, he noted made the plaintiff to sue the state chairman and that the court issued the order of ‘interim injunction’ pending the determination of the Motion on Notice.
According to him, the dou of Misau and Ganduje have allegedly failed to obey the order hence the complainant filed a fresh application to the court to punish the respondents for Contempt and charge them a fine of N2 million when convicted.
“One Alhaji Al-Muntaqa Zubairu a committed member of the All Progressives Congress (APC), Bauchi State Chapter filed an Originating Summons on the 3rd day of April, 2023 before the Bauchi State High Court and obtained an Interim Order granted by Justice Lamido K. Umar of the High Court No. 7, as follows:
“That an order of Interim Injunction be and is hereby made restraining the first defendant/respondent from further parading himself as a member of the second defendant/respondent or the chairman of the second defendant/respondent, pending the determination of the motion on notice.
“That an order of Interim Injunction be and is hereby made restraining the second defendant/respondent from dealing with the first defendant/respondent as a member or the chairman of the second defendant/respondent, pending the determination of the motion on notice.
“That despite the service of the order on the respondents, they continue in breach, hence this contempt proceedings.”, the complainant stated in the court’s application sent to Daylight Reporters on Wednesday.
