Former Senator of Zamfara Central Senatorial District, Sen. Kabiru Marafa has said that the occupant of the seat of the Governor of Zamfara State as well as members of national and state assemblies between 2019 – 2023 must not be All Progressive Congress (APC) faithfuls.
In an interview with Arise TV, Sen. Marafa maintained that going by the supreme court judgment on 2019 APC primary elections, the party did not participate in the 2019 elections and therefore cannot occupy any elective position in the state.
According to him, “The judgement made by supreme court said APC ought not to have participated in the 2019 elections and that means there was no APC at all.
“Now I am asking this question and I want every Nigerian to tell me, can a man that is non existent have children? You can’t. So as far as the law is concerned there was no APC on 2019 ballot paper and therefore APC cannot have a Governor, Senators, members of house of representatives and members of state assembly by that supreme court judgment.
“Therefore any attempt by anybody to say that he is a Governor of APC between 2019 and 2023 without reasons of may be death, resignation, or any reason if bye-elections, you cannot call yourself an APC legislator for doing so is a negation of the supreme Court judgment.” He said.
Commenting on Gov. Mai Mala Buni’s Chairmanship of the APC, Sen. Marafa said the appointment of the Yobe State Governor as Caretaker Chairman of the party is a clear violation of the APC constitution which forbids officers of the party from holding any executive position in government.
“We are going to challenge even the legality of him (Mai Mala Buni) being chairman of the APC. When you look at the APC constitution, section 17 subsection 4 in particular, forbade Mai Mala from being the chairman of the party.
“I have alerted Mr. President long time ago that we should be very very wary of these Banana peels”. He added
