A Magistrates’ Court in Makurdi on Wednesday ordered that two brothers, charged with culpable homicide, be remanded in a correctional centre, pending legal advice.
The police charged Yangeliam and Agededeatyo Kentyo , both who live in Gwer East L.G.A of Benue with three counts of criminal conspiracy, armed robbery and culpable homicide.
Magistrate Ajuma Igama, did not take the plea of the brothers for want of jurisdiction.
Igama ordered the police to return the case file to the Office of the Benue Director of Public Prosecutions for legal advice.
She adjourned the case until Oct 6, 2020 for further mention.
Earlier, the Prosecution Counsel, Sgt. Ato Godwin told the court that the case was reported at the Divisional Police Headquarters Tse-Agberagba Gwer East by the complainant Moses Warem of St. Veronica Catholic church Tse- Agberagba.
He alleged that the Kentyo brothers attacked the complainant’s cousin, Denen Nor , 32, with a machete and stole his motorcycle, worth N250,000.
The prosecution said that Nor later died from his injuries following the attack.
Godwin said investigation into the matter was still ongoing and prayed for an adjournment.
He said the offence contravened the provisions of sections 6(b), 1(1)(2)(a)(b) of the Robbery and Firearms Special Provisions Act 2004 and Section 222 of the Penal Code Laws of Benue 2004.
