Zamfara State Chapter of Peoples Democratic Party (PDP) has suffered yet another round of defeat as the Apellate Court Sokoto Division struck out an appeal files by the party.
The Zamfara State PDP had in an appeal filed by the party’s governorship candidate, Lawal Dauda Dare, Adamu Maina Waziri, and Bala Bande sought the Court to validate it’s Primary election which was annulled by another Court over irregularities.
The Presiding judge Muhammad Shu’aibu while delivering judgement said, the appeal had to be dismissed for lack of merit and described it as a mere academic exercise which the Court will not entertain.
According to him, while the Appellants have their constitutional rights to appeal, however, the issue before the court is beyond the stipulations of the individual’s constitutional right.
Justice Shu’aibu added that, the appellants have lost their right to appeal by complying with the order of the lower court and participating in the fresh primary.
He therefore upheld the judgement of the lower court which nullified the party’s primary election which produced Dauda Lawal Dare as it’s governorship candidate for the 2023 general elections over some irregularities.
One of the irregularities observed was that, the party denied women delegates from participating in the conduct of the primaries and orders a fresh primary elections.
The Court further awarded a N100,000 against the appellants for filing preliminary objection which consume substantial time of the court.
