A Grade I Area Court in Kubwa, Abuja, on Wednesday issued a bench warrant for the arrest of a 39- year-old businesswoman, Ruth Udezi over her failure to appear for trial.
The Judge, Muhammad Adamu, however, discharged the second defendant, Tina Ogbodo, following her defence counsel, Moses Ugwummadu’s application for the court to discharge her.
Adamu adjourned the matter until Sept. 8 for hearing.
Ugwummadu had applied for the court to discharge Ogbodo, saying there was no evidence to prove the allegations against her.
He added that his client had been diligent in attending her trial and urged the court to grant his prayer.
The prosecution counsel, John Okpa did not oppose the defence counsel’s application and urged the court to exercise its discretion.
Udezi of Igara, Edo state and Ogbodo of Kubwa, Abuja were charged with intentional insult with intent to provoke breach of peace and criminal intimidation.
The defendants had pleaded not guilty to the charge preferred against them by the police on Nov. 19.
The prosecution counsel said the defendants acted in a violent manner and used abusive words on each other and threatened each other’s lives thereby disturbing public peace on Sept. 3.
The offence, he said, contravened the provisions of sections 399 and 397 of the Penal Code.
